Since law n ° 90-1259 of December 31, 1990 codified in article L.741-2 of the Commercial Code, the profession of clerk of Commercial Court is represented with the public authorities by the National Council of Commercial Courts, endowed with legal personality and responsible for ensuring the defense of its collective interests.
In the jurisdiction of each court of appeal, the clerks of the commercial courts elect a member of the national council when their number in this court exceeds five members. Depuis la loi n°90-1259 du 31 décembre 1990 codifiée à l’article L.741-2 du Code de commerce, la profession de greffier de tribunal de commerce est représentée auprès des pouvoirs publics par le Conseil national des greffiers des tribunaux de commerce, doté de la personnalité morale et chargé d’assurer la défense de ses intérêts collectifs.
Dans le ressort de chaque cour d'appel, les greffiers des tribunaux de commerce élisent un membre du Conseil national lorsque leur nombre dans cette cour excède cinq membres. Dans le cas contraire, le membre du Conseil national est élu par un collège composé de greffiers du ressort de la cour d'appel et de ceux exerçant dans un ressort de cour d'appel voisin. La durée de ce mandat est de quatre ans renouvelable une fois.
Ces greffiers élisent ensuite pour une durée de deux ans le Bureau du Conseil national composé d’un président, d’un vice- président, d’un secrétaire, d’un trésorier et de trois chargés de mission. Le Bureau se réunit tous les mois.
Des Commissions sont chargées de suivre les dossiers qui concernent la profession : Commission juridique (section judiciaire et section RCS), Commission déontologie, règles professionnelles et inspections, Commission formation, Commission dématérialisation et statistiques, Commission mixte paritaire, Commission locaux et archives des greffes.
Le Conseil national est investi de quatre missions principales :
